Electric Bike and Electric Scooter Safety & Liability (Florida Law Essentials 2026 Update)
PARENT NOTIFICATION: ELECTRIC BIKE AND ELECTRIC SCOOTER SAFETY & LIABILITY
TO: Parents and Guardians of Lyons Creek Middle School Students
SUBJECT: Legal Requirements for Bicycles, E-Bike and E-Scooter Use
Dear Parents, As e-bike and e-scooter use continues to rise in our City, we want to ensure that you are fully informed of the Florida Statutes regulating these devices. Under Florida law (as of 2026), these motorized devices are no longer considered "toys" and operating one comes with legal responsibilities for both the rider and the parent.
The "E-Moto" Danger (Sur-Ron, Talaria, E-Ride)
Many students are operating vehicles that may look like mountain bikes, however they are not and some of these vehicles lack functional pedals or exceed 750 watts. Pursuant to Section 316.003, Florida Statutes, these are NOT e-bikes. Under these circumstances, a minor who operates a vehicle without functioning pedals or one that exceeds 750 watts, may to subject to the following penalties:
1. Criminal Charges: If your child rides an "e-moto" without a license, registration, or insurance, they can be cited for Operating a Motor Vehicle Without a License — a criminal offense.
2. License Delays: A criminal traffic citation at age 13 or 14 can lead to a court-ordered suspension or delay of your child’s ability to get a Learner’s Permit or Driver’s License at age 15/16.
Florida Law Essentials (2026 Update)
Rule Requirement
Helmets: Mandatory for all riders under 16 years old for bicycles, e-bikes and e-scooters. Must meet federal standards. See F.S.S. 316.2068 & 316.2065.
Equipment: The E-bike must have a permanent label stating its Class (1, 2, or 3) and top speed. See F.S.S. 316.003 & 316.20655.
Sidewalks: Riders must yield to pedestrians and give an audible signal before passing.**Effective July 1, 2026, operation of an electric bike cannot be greater than 10 miles per hour on a sidewalk where a pedestrian is within 50 feet**.
Motorized E-scooters: Not required to have a license, registration or insurance. Must follow bicycle laws. See F.S.S. 316.2065.
Motorized E-scooters and E-bikes: Must be 750 watts or less (check the sticker or manufacturer).
School Enforcement Action
Beginning February 23, 2026, the Coconut Creek Police Department will be conducting safety stops in the area of Lyons Creek Middle School. Please be advised that the following corrective actions may be taken for non-compliant vehicles, failure to wear required helmets, or when e-bikes are recklessly operated.
1. Non-Compliant Vehicles: Bikes that do not meet the legal definition of an e-bike (no pedals/over-powered/more than 750 watts) may be impounded.
2. Safety Citations: Students without helmets or those riding recklessly will receive a warning that may require a parent-officer meeting.
Action Item: Please inspect your child’s e-bike or e-scooter today. Ensure that it has functional pedals, proper sticker manufacturing, and ensure that your child is properly wearing their safety helmet. We encourage you to read Florida State Statutes regarding bicycles, e-bikes, and e-scooters; Sections 316.2128, 316.003, 316.2065, 316.2068 and 316.20655.

BCPS Parent Permission Refusal Form
BCPS Parent Permission Refusal Form
Our school is participating in a Customer Survey sponsored by Broward County Public Schools. This survey will ask 3rd through 12th-grade students’ opinions about their school and health behaviors. This survey will address questions related to unintentional injuries and violence, as well as the use of and attitude towards tobacco, alcohol, and other drugs. Students will be asked to participate in this survey. The survey will take approximately fifteen (15) minutes to complete.
Participation in this survey will cause little to no risk to your child. The only potential risk may be that some students might find certain questions to be sensitive. The survey has been designed to protect your child’s privacy and is completely anonymous. For the survey results to be accurate, it is important that all students, regardless of whether they have engaged in health-risk behaviors or not, are given an opportunity to participate in the survey. It is important to keep in mind that the survey is voluntary. No action will be taken against the school, you, or your child if your child does or does not take the survey. If you would like to see the survey, a copy is available at
